Vibration Elevation respects your privacy and wants you to understand what happens to information you provide when you use our websites, products, services, and interactive applications.

This Privacy Policy describes how Vibration Elevation LLC (“Vibration Elevation,” “we,” “us,” or “our”) collects, uses, stores, processes, and shares information when you:

  • Visit vibrationelevation.com or another website that links to this Privacy Policy;
  • Purchase or use a Vibration Elevation product or service;
  • Create or access an account;
  • Use Elevate, our interactive conversational service;
  • Join an email list, complete a form, or communicate with us;
  • Participate in beta testing, courses, programs, events, or other Vibration Elevation offerings; or
  • Otherwise interact with Vibration Elevation.

Collectively, these are referred to in this Privacy Policy as the “Services.”

1. Information We Collect

The information we collect depends on how you interact with Vibration Elevation and which Services you use.

Information You Provide to Us

We may collect information that you voluntarily provide, including:

  • Name;
  • Email address;
  • Telephone number, when applicable;
  • Account or access information;
  • Purchase and transaction information;
  • Information submitted through forms, surveys, waitlists, or registrations;
  • Communications you send to us;
  • Customer-support requests;
  • Information you provide while participating in courses, programs, events, or beta testing; and
  • Information you voluntarily enter into Elevate.

You are not required to provide more personal information than is reasonably necessary to use a particular Service.

Payment Information

If you purchase a product or service, payment information may be processed by third-party payment processors such as Stripe or PayPal.

Vibration Elevation does not intentionally store your complete payment-card number or card security code on its own systems when those credentials are handled by our payment processor.

Information Collected Automatically

When you visit or use our Services, certain technical information may be collected automatically by us or by service providers that operate our websites and technology.

This may include:

  • Internet Protocol (IP) address;
  • Browser type;
  • Device type;
  • Operating system;
  • Referring page or URL;
  • Pages or features accessed;
  • Date and time of access;
  • General usage and diagnostic information;
  • Security-related information; and
  • Approximate geographic information that may be inferred from an IP address.

We do not claim to collect precise GPS location information unless a particular Service expressly asks you for permission to provide it.

2. Elevate and Conversation Data

Vibration Elevation offers an interactive conversational service called Elevate.

When you use Elevate, information you enter into the conversation is processed so that Elevate can respond to you and continue the conversation in context.

What You May Choose to Discuss

Conversation content may include information about your:

  • Experiences;
  • Thoughts;
  • Feelings;
  • Relationships;
  • Concerns;
  • Beliefs;
  • Physical sensations;
  • Personal circumstances; or
  • Other subjects you choose to discuss.

You decide what to enter. Conversation content may sometimes contain personal information or information considered sensitive under applicable privacy laws.

We encourage you not to enter unnecessary identifying information such as full names, addresses, financial account numbers, passwords, medical records, Social Security numbers, or other highly identifying information.

You do not need to provide this type of information for Elevate to work.

3. How Artificial Intelligence Is Used in Elevate

Elevate uses artificial-intelligence technology provided through the OpenAI API to generate conversational responses.

When you use Elevate, conversation information necessary to generate a response is transmitted to OpenAI for processing.

OpenAI states that data submitted through its API is not used to train or improve OpenAI's models by default unless the customer affirmatively opts in to data sharing for those purposes.

Vibration Elevation's current implementation also requests that Responses API application-state storage be disabled (store: false).

This does not, however, mean that no information can ever be retained by OpenAI.

Under our current OpenAI account configuration, information processed through the API may be retained by OpenAI in abuse-monitoring logs for up to 30 days, unless longer retention is required by law or is reasonably necessary for security, fraud, or abuse-prevention purposes.

Vibration Elevation does not currently have OpenAI's Zero Data Retention controls enabled.

4. Conversation Context

Elevate is designed to have a continuing conversation rather than treating each message as an unrelated request.

For that reason, relevant portions of the conversation may be provided to the artificial-intelligence service along with a new message so that Elevate can respond in context.

This processing is necessary for the conversational functionality of the Service.

5. Beta Conversation Storage

During beta testing, Vibration Elevation saves a pseudonymous copy of Elevate conversations so that we can evaluate how the service is functioning, identify problems, troubleshoot unexpected behavior, and improve Elevate.

These beta transcripts are associated with a system-generated session identifier rather than intentionally being stored in the transcript database under your name or email address.

Pseudonymous does not mean anonymous.

If you type your name, another person's name, an employer, a location, a medical condition, or other identifying information into a conversation, that information may appear within the stored transcript itself.

This is why we ask beta users not to include information they would not be comfortable having stored as part of a beta test.

6. Why We Review Beta Conversations

During development and beta testing, authorized Vibration Elevation personnel may review stored conversations.

We do this for purposes such as:

  • Evaluating whether Elevate is responding appropriately;
  • Finding conversational problems or unexpected behavior;
  • Improving the user experience;
  • Testing changes to the Service;
  • Troubleshooting technical problems;
  • Evaluating safety and reliability; and
  • Developing and improving Elevate.

We do not save beta transcripts for the purpose of selling people's personal conversations to advertisers.

7. Elevate Access and Account Information

Information used to determine whether you are authorized to access Elevate may include information such as your email address, account identifier, access status, and technical authentication or session information.

This access information is maintained separately from the pseudonymous conversation transcript system.

For example, Vibration Elevation may need to know that a particular customer has active access to Elevate without intentionally attaching that customer's name or email address to every conversation transcript.

8. How We Use Your Information

Depending on how you interact with us, we may use information to:

  • Provide the Services you request;
  • Operate Elevate;
  • Authenticate users and manage access;
  • Process purchases and subscriptions;
  • Maintain customer accounts;
  • Respond to questions or support requests;
  • Send transactional or service-related communications;
  • Provide requested products, courses, programs, or digital content;
  • Improve our websites, products, and Services;
  • Review and improve Elevate during beta testing;
  • Diagnose technical problems;
  • Maintain security;
  • Prevent fraud, misuse, or unauthorized access;
  • Maintain appropriate business and accounting records;
  • Comply with legal obligations;
  • Protect our legal rights or the rights and safety of others; and
  • Send marketing communications when permitted by law and consistent with your communication preferences.

We may also use information for another purpose when you have specifically consented to that use.

9. Marketing Communications

If you subscribe to our email list, request information, purchase certain products, or otherwise consent to receive marketing communications, we may send you information about Vibration Elevation products, services, programs, content, or offers.

You can unsubscribe from marketing emails at any time by using the unsubscribe link included in the email.

Unsubscribing from marketing communications does not necessarily prevent us from sending necessary transactional or service-related messages, such as purchase confirmations, access emails, security notices, or customer-support responses.

10. Service Providers

We use third-party companies to help operate Vibration Elevation.

Depending on the Services you use, these providers may process information on our behalf.

OpenAI

Provides artificial-intelligence processing used by Elevate.

Cloudflare

Provides infrastructure used to operate and secure portions of Elevate, manage authorized access, and store certain application information.

GoHighLevel / LeadConnector

May be used for customer records, forms, email communications, workflows, product access, marketing, and related business functions.

Stripe and/or PayPal

May process payments and related transaction information.

Website, Analytics, Email, and Infrastructure Providers

We may also use providers that help us host websites, send communications, understand website usage, provide security, or operate other aspects of the Services.

These companies may process information as necessary to perform services for us and may have their own legal obligations concerning information they process.

11. When We May Disclose Information

We may disclose information when reasonably necessary:

  • To service providers that help us operate the Services;
  • To process a transaction or provide a product you requested;
  • To comply with applicable law, regulation, subpoena, court order, or other valid legal process;
  • To investigate suspected fraud, misuse, security incidents, or violations of our terms;
  • To protect the rights, property, or safety of Vibration Elevation, our users, or others;
  • In connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction; or
  • With your consent or at your direction.

We do not sell your personal conversations to advertisers.

12. Cookies and Similar Technologies

Our websites and Services may use cookies and similar technologies for purposes such as:

  • Keeping Services functioning;
  • Remembering preferences;
  • Maintaining sessions;
  • Security;
  • Understanding website usage; and
  • Analytics.

Browser settings may allow you to block or remove cookies. Disabling certain cookies may affect the functionality of some Services.

13. How Long We Keep Information

Different kinds of information may need to be retained for different periods.

We generally retain personal information only for as long as reasonably necessary for the purpose for which it was collected, including to provide Services, maintain necessary business records, comply with legal or accounting obligations, resolve disputes, prevent fraud, and enforce agreements.

Elevate Beta Transcripts

During beta testing, Vibration Elevation is currently retaining pseudonymous Elevate transcripts while the service is being tested, evaluated, and improved.

We have not yet established the final retention period that will apply to production Elevate conversations.

We intend to establish an appropriate production retention practice as Elevate moves beyond beta and will update this Privacy Policy when that practice is established.

OpenAI Processing

As described above, under our current OpenAI API configuration, OpenAI may retain information in abuse-monitoring logs for up to 30 days, subject to OpenAI's policies and exceptions.

Transaction and Business Records

Certain purchase, tax, accounting, contractual, or other business records may be retained for longer periods when reasonably necessary or legally required.

When information is no longer reasonably needed, we may delete, anonymize, aggregate, or otherwise dispose of it as appropriate.

14. Security

We use reasonable administrative, technical, and organizational measures intended to protect the information we process.

For example, access to Elevate is protected through authentication and authorization mechanisms, and portions of our application infrastructure are separated according to their function.

However, no website, application, database, Internet transmission, or electronic storage system can be guaranteed to be completely secure.

You should therefore use reasonable care when deciding what information to provide online.

In particular, please avoid entering unnecessary highly sensitive or identifying information into Elevate.

15. Sensitive Information and Elevate

The nature of Elevate means that users may choose to discuss subjects that are personal or sensitive.

We do not require you to provide sensitive personal information simply to use Elevate.

If you choose to provide such information, it may be processed as part of the conversation as described in this Privacy Policy.

Elevate is not intended to replace medical, mental-health, legal, financial, emergency, or other licensed professional services.

If you require professional or emergency assistance, you should seek an appropriate qualified professional or emergency resource rather than relying on Elevate.

16. Information About Other People

Please use care when entering information about another person into Elevate or otherwise providing it to Vibration Elevation.

Whenever possible, avoid providing another person's full name or other identifying information when it is unnecessary for the conversation.

You are responsible for the information you choose to provide about other individuals.

17. Children and Minors

Vibration Elevation's Services, including Elevate, are intended for adults age 18 and older.

We do not knowingly solicit or collect personal information through Elevate from individuals under 18 years of age.

If we learn that we have collected personal information through Elevate from an individual under 18, we will take reasonable steps to delete the information as appropriate.

18. Your Privacy Rights

Depending on where you live, privacy laws may provide you with certain rights concerning your personal information.

These may include, where applicable, the right to:

  • Know whether we process your personal information;
  • Request access to personal information we maintain about you;
  • Request correction of inaccurate information;
  • Request deletion of personal information;
  • Request a portable copy of certain information;
  • Restrict or object to certain processing;
  • Withdraw consent when processing is based on consent;
  • Opt out of certain forms of targeted advertising, sale, sharing, or profiling where applicable;
  • Appeal certain decisions concerning a privacy request; and
  • Submit a complaint to an appropriate data-protection authority.

These rights vary by jurisdiction and are subject to exceptions and limitations under applicable law.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

19. United States Privacy Rights

Residents of certain U.S. states may have additional rights under applicable state privacy laws.

Depending upon the law applicable to you and whether Vibration Elevation is subject to that law, these rights may include access, correction, deletion, portability, and the ability to opt out of certain uses of personal information.

Some state privacy laws apply only to businesses that meet specified thresholds relating to revenue, the amount of personal information processed, or other criteria. Accordingly, not every state privacy statute necessarily applies to Vibration Elevation.

If an applicable state privacy law gives you a right concerning information we maintain about you, you may submit a request using the contact information below.

20. International Privacy Rights

If you live outside the United States, applicable privacy laws may provide additional rights concerning your personal information.

Where applicable, we will process privacy requests in accordance with the laws that apply to Vibration Elevation and the individual making the request.

Depending on the jurisdiction, our legal bases for processing personal information may include:

  • Your consent;
  • Performance of a contract or providing a Service you requested;
  • Compliance with legal obligations;
  • Protection of vital interests; and
  • Our legitimate interests in operating, securing, administering, and improving our Services, where those interests are not overridden by applicable individual rights.

Where processing is based on consent, you may have the right to withdraw that consent.

Withdrawing consent does not affect the lawfulness of processing that occurred before the withdrawal.

21. Requesting Access, Correction, or Deletion

You may contact us to request access to, correction of, or deletion of personal information we maintain about you.

We may need to verify your identity before fulfilling certain requests.

We will use information provided for verification only as reasonably necessary to verify and process the request.

Certain information may not be subject to deletion when we are legally permitted or required to retain it, such as information necessary for:

  • Tax or accounting obligations;
  • Fraud prevention;
  • Security;
  • Establishing or defending legal claims;
  • Compliance with applicable law; or
  • Other legally permitted purposes.

Requests Concerning Elevate Conversations

Because beta Elevate transcripts are designed to be stored pseudonymously rather than directly under a user's name or email address, locating a particular transcript may require additional information and may not always be possible from an email address alone.

If you would like us to investigate whether a particular Elevate conversation can reasonably be identified and deleted, contact us and provide enough information for us to evaluate the request without unnecessarily disclosing additional sensitive information.

22. Do-Not-Track and Privacy Preference Signals

Browsers and devices may provide Do-Not-Track or other privacy preference mechanisms.

The legal and technical requirements surrounding these signals continue to evolve.

Where applicable law requires Vibration Elevation to recognize a particular browser-based opt-out or privacy preference signal, we will endeavor to honor that requirement.

Otherwise, the availability of a browser signal does not necessarily mean that every part of our Services can interpret or act upon it.

23. Third-Party Websites and Services

Our Services may contain links to websites, platforms, payment processors, social networks, or other services operated by third parties.

We do not control the privacy practices of those third parties.

If you leave our Services or provide information directly to another company, that company's privacy policy may apply.

We encourage you to review the privacy policies of third-party services you use.

24. Business Transfers

If Vibration Elevation is involved in a merger, acquisition, restructuring, financing, sale of assets, or similar business transaction, information may be transferred as part of that transaction where permitted by law.

Any successor organization may assume rights and obligations concerning information subject to this Privacy Policy and applicable law.

25. Changes to This Privacy Policy

We may update this Privacy Policy as our Services, technology, legal obligations, or privacy practices change.

The date at the top of this page indicates when this Privacy Policy was last updated.

If we make material changes, we may provide additional notice where appropriate, such as by posting a notice on our website or within the affected Service.

We encourage you to review this Privacy Policy periodically.
